By accessing and using MyATMM.com (the "Site"), you agree to be bound by these Terms of Service. Please read them carefully before using our services.
You are permitted to use the Site and Content for your personal, non-commercial use only. The Site and Content are and shall remain the property of MyATMM.com and is protected by copyright, trademark, patent, and/or other intellectual property, proprietary, work product rights and laws. You may use the Site and Content for your personal, noncommercial use, provided that you keep intact all copyright, trademark, patent and other proprietary notices.
Except as expressly authorized in advance by MyATMM.com in writing, you agree not to reproduce, modify or create derivative works based on, rent, lease, loan, sell, distribute, publish, publicly perform or display, reverse engineer, de-compile or dissemble, all or any part of the Site or Content.
MyATMM.com, in its sole discretion, may terminate your access to or use of the Site and Content, at any time and for any reason. Your access to or use of the Site and Content may be terminated without notice. MyATMM.com shall not be liable to you or any third party for any termination of your access to the Site or Contents, or to any such information or files, and shall not be required to make such information or files available to you after any such termination.
Your use of the Site and Content is conditioned on your compliance with the rules of conduct set forth here. You will not:
MyATMM may optionally integrate with one or more third-party brokerages (each, a "Broker") to allow you to view account information and to submit orders that you yourself initiate. The terms in this section apply to any such integration, including any new Brokers we add in the future.
MyATMM is a software tool, not a broker-dealer. MyATMM is not registered as a broker-dealer, is not a member of FINRA or SIPC, and is not a Registered Investment Advisor (RIA). MyATMM does not provide investment, financial, legal, or tax advice. Nothing displayed in or produced by MyATMM constitutes a recommendation to buy, sell, or hold any security.
You direct every order. Any order submitted to a Broker through MyATMM is initiated by you and submitted at your sole direction and judgment. You are solely responsible for your trade decisions, including but not limited to: order selection, strike and expiration choices, position sizing, execution quality, fill price, partial fills, missed fills, slippage, market impact, order rejections, and any gains or losses that result.
Your Broker remains the custodian. MyATMM does not hold, custody, control, or have possession of your funds or securities at any time. Your Broker remains the sole custodian of your account, funds, and positions, and your relationship with your Broker is governed by the agreements between you and that Broker.
To connect a Broker, you authenticate with the Broker through that Broker's own login flow (OAuth or equivalent). The Broker issues MyATMM access credentials that allow MyATMM to read account state and to submit orders that you explicitly initiate within MyATMM. MyATMM does not place orders on your account autonomously and does not engage in algorithmic, automated, or discretionary trading on your behalf.
You may revoke MyATMM's access to your Broker account at any time, either through the Broker's own account portal or through the MyATMM authorization administration page for that Broker.
For security, support, and compliance purposes, MyATMM maintains a durable audit log of every order-related action taken through the integration, including order submissions, modifications, cancellations, and authentication events. These audit records are retained for seven (7) years and are accessible to MyATMM administrators in response to support requests, security investigations, or legal process.
MyATMM does not guarantee that any order will be received by your Broker, accepted, routed, filled, cancelled, or modified within any particular time frame, or at all. Order outcomes are determined entirely by your Broker, by the exchanges and venues to which your Broker routes the order, and by prevailing market conditions. Connectivity, latency, downtime, software defects, and third-party service outages may affect MyATMM's ability to display account state, submit orders, or reflect order status.
You agree that MyATMM (specifically including its officers, directors, owners, partners, employees, and agents) will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to your use of the broker integration, including without limitation losses from trades, missed trades, delayed trades, or trades you did not intend to place.
By accessing and using the Site and Content, you agree to indemnify, defend and hold harmless MyATMM.com (specifically including its officers, directors, owners, partners, employees, agents, information providers, licensors and licensees) (collectively, the "Indemnified Parties") from and against any and all claims, losses, costs and expenses (including attorneys' fees) arising out of or relating to (a) any breach (or claim, that if true, would be a breach) by you of these Terms and (b) your use of or activities in connection with the Site.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You shall not enter into any settlement agreement which affects the rights of any of the Indemnified Parties or requires the taking of any action by any of them, without our prior written approval.
The Site is controlled and operated by MyATMM.com from the United States, and is not intended to subject MyATMM.com to the laws or jurisdiction of any country or territory other than that of the United States. MyATMM.com does not represent or warrant that the Site or any part thereof is appropriate or available for use in any particular jurisdiction other than the United States and only in those US states and territories where MyATMM.com is registered or licensed or exempt from registration or licensing under applicable state or federal law.
In choosing to access the Site, you do so on your own initiative and at your own risk, and you are responsible for complying with all local laws, rules and regulations. We may limit the Site's availability to any person, geographic area or jurisdiction.
MyATMM.com may amend these terms of use at any time in its discretion, by posting revisions on the Site.
